phlog.net Terms and Conditions of Service
By registering and/or using the phlog.net website ("phlog.net", "the site"), brought to you by Phlog Ltd ("Phlog"), you agree to and affirm to comply with the following terms and conditions of using the service ("Terms of Service").
What We Are
phlog.net is an online photosharing community. You as a user upload photos ("image", "graphic", "content", "data") from your camera phone, Mac or PC and display them publicly on your dedicated web space ("your phlog"). This is fun, but it necessitates adhering to several legal guidelines and standards set out below.
Prerequisites of Use and Your Duties
By using phlog.net, you affirm that:
You are 14 years or older and you are solely responsible for any action that occurs on the site using your account. Accordingly, you keep your password secure and never share it with anyone. You will not harass, insult or discriminate against phlog.net users. You will never use phlog.net for any illegal or unauthorized activity. If you are unsure if what you are doing is ok, ask us first. You are reponsible for your content and relieve Phlog of any liability for the content (data, images, graphics, text, audio, video, and links) that you post on the site. You must seek permission from Phlog prior to using phlog.net for any commercial or professional purposes. You will not hack phlog.net or transmit malicious code (worms, viruses and the like) using phlog.net. If there is a security issue, tell us. You will not spam phlog.net users. You will not violate any laws by using phlog.net, including all copyright regulations for your and other jurisdictions in which phlog.net can be used. You are using phlog.net at your own risk and cannot hold Phlog responsible for any content posted on the site.
Your failure to comply with the Prerequisites of Use and Your Duties will result in termination of your account and a lifelong ban from the phlog.net community. Since phlog.net is really cool, please think twice about being the idiot that makes it unfun.
Copyright
Your images are your images. However, by posting them on phlog.net, you grant Phlog a license to store them and display them publicly. You also allow us to promote our services by using your images, as well as your RSS feeds, including in places which are not phlog.net. You have the right to delete your images at any time. As we said above, they're yours. For a variety of technical reasons, they may remain on our servers for some time after you deleted them. However, they will be removed in due course. We encourage but do not enforce image sharing. If you want to be specific about what others can and cannot do with your content, go to Creative Commons and post the terms under which you license the things you posted on your phlog.
Phlog is lawfully bound to respect copyright on our sites, even though it's a pain. We must therefore act when we receive notice of an infringement. To get us to follow up on any claim to copyright, please send an email to copyright@phlog.net containing:
- A decription of the copyrighted content and its location on the phlog.net site as a URL
- Your name and contacts including phone and email
- A statement that the content is lawfully yours along with a statement that the information you provide is accurate
- Power of attorney if you are acting as the agent of the copyright owner
Our Conditions
There are things that we, as a company, have to reserve as our rights so that we stay out of jail. These may sound harsh but they're quite alright compared with what other companies do to you:
We may alterate the service at any time, without notification. This includes termination of the service. We reserve the right to alter these Terms of Service at any time. Any change in the Terms of Service will be reflected at http://phlog.net/site/terms. By reusing the service, you agree to the changes. We reserve the right to refuse service to anyone for any reason at any time. We may remove content we consider unlawful, offensive or otherwise harmful to the phlog.net site for any reason and at any time. You may not hotlink, unless you link back to phlog.net in a separate text link. Any abuse of phlog.net, including but not limited to hotlinking, results in the termination of your account.
Special Conditions for Paying Users
Paying users are our lifeblood and we pledge to treat you well. Nevertheless, some special conditions apply to paying users, to avoid abusive behaviour:
Paid users have a right to the additional account features set out on the account comparison page. Other features are provided at our discretion, which means we can change them at will (we will only do so if we believe this benefits you). All paying users may terminate their account with us at any time with a two week notice period. Upon termination, accounts are downsized to the free level at the end of the payment period (for monthy payments, the end of the month; for yearly payments, at the end of the year), unless the users chooses to delete the account. As a principle, there can be no reimbursement once payment has been made to us. We are a small company and really can't affort all the fees involved in that. At times, we may also feel that we need to alter the service in some significant way (features, layout, design, functionality). Such a material alteration obviously gives you the right to terminate your account with us to the conditions laid out above. Again, no reimbursement for prepaid periods can be made.
